1. ACCEPTANCE OF TERMS
Your access to and use of JamesRose.com, JamesRose.net, JamesRose.org, JamesRose.tv, lordandmasters.com, jamjahr.com, unitedpeeps.com, and unitedpeeps.co.uk ("James Rose' Web Sites" or
"the Web Sites") is subject exclusively to these Terms and Conditions.
You will not use the Website for any purpose that is unlawful or prohibited by
these Terms and Conditions. By using James Rose' Web Sites you are fully
accepting the terms, conditions and disclaimers contained in this notice. If
you do not accept these Terms and Conditions you must immediately stop using
the Web Sites.
2. ADVICE
The contents of James Rose' Web Sites do
not constitute advice and should not be relied upon in making or refraining
from making, any decision.
3. CHANGES TO WEB SITE
James Rose' webmasters reserves the right
to:
3.1 change or remove (temporarily or
permanently) the Website or any part of it without notice and you confirm that any
of James Rose' Web Sites shall not be liable to you for any such change or
removal; and
3.2 change these Terms and Conditions at
any time, and your continued use of the Web Sites following any changes shall
be deemed to be your acceptance of such change.
4. LINKS TO THIRD PARTY WEBSITES
James Rose' Web Sites may include links to
third party websites that are controlled and maintained by others. Any link to
other websites is not an endorsement of such web sites and you acknowledge and
agree that we are not responsible for the content or availability of any such
sites.
5. COPYRIGHT
5.1 All copyright, trade marks and all
other intellectual property rights in the Website and its content (including
without limitation the Web Sites' design, text, graphics and all software and
source codes connected with the Web Sites) are owned by or licensed to James
Rose or otherwise used by James Rose' Web Sites as permitted by law.
5.2 In accessing the Web Sites you agree
that you will access the content solely for your personal, non-commercial use.
None of the content may be downloaded, copied, reproduced, transmitted, stored,
sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Web
Sites for personal, non-commercial home use only.
6. DISCLAIMERS AND LIMITATION OF LIABILITY
6.1 James Rose' Web Sites are provided on
an "AS IS" and "AS AVAILABLE" basis without any
representation or endorsement made and without warranty of any kind whether
express or implied, including but not limited to the implied warranties of
satisfactory quality, fitness for a particular purpose, non-infringement,
compatibility, security and accuracy.
6.2 To the extent permitted by law, James
Rose' Web Sites will not be liable for any indirect or consequential loss or
damage whatever (including without limitation loss of business, opportunity,
data, profits) arising out of or in connection with the use of any of the Web
Sites.
6.3 James Rose' Web Sites makes no
warranty that the functionality of the Web Sites will be uninterrupted or error
free, that defects will be corrected or that the Website or the server that makes it
available are free of viruses or anything else which may be harmful or
destructive.
6.4 Nothing in these Terms and Conditions
shall be construed so as to exclude or limit the liability of any James Rose'
Web Site for death or personal injury as a result of the negligence of James
Rose' Web Sites or that of their employees or agents.
7. SECURITY CLEARANCES AND ACCESS TO CLASSIFIED INFORMATION, THE PROTECTED RESOURCES AND DOWNLOADS AREAS ON JAMESROSE.COM
7.1 No person without a security clearance will have access to James Rose' contact information, the protected resources and downloads areas on JamesRose.com.
7.2 Only James Rose will act upon an application for access to this classified information.
7.3 To the extent practicable, applications for access to James Rose' contact information, the protected resources and downloads areas on JamesRose.com shall describe the information to which access is desired and its level of classification (confidential, secret or other); the reasons for requesting access; the names of individuals for whom access is requested; and the reasons why access is requested for those individuals.
7.4 James Rose will consider requests for appropriate security clearances in reasonable numbers; and conduct his review and grant or deny these in accordance with paragraph (l).
7.5
James Rose will not grant security clearances for access to James Rose' contact information, the protected resources and downloads areas on JamesRose.com, unless it determines that the available unclassified information is inadequate on the subject matter involved.
7.6
For good cause, James Rose may postpone action upon an application for access to James Rose' contact information, the protected resources and downloads areas on JamesRose.com.
7.7 James Rose will grant access to classified information only up to the level for which the persons described in paragraphs (f) and (g) of this section are cleared and only upon an adequate commitment by them not to disclose such information subject to penalties as provided by law.
7.8 James Rose will not in any circumstances grant access to classified information:
i.
Unless it determines that the grant is not inimical to the common defence and security; and
ii.
Which it has received from another Government agency, without the prior consent of the originating agency.
7.9 Upon completion of a hearing, James Rose will terminate all security clearances granted pursuant to the hearing and may require the disposal of classified information to which access has been granted or the observance of other procedures to safeguard this information.
7.10 Grants are not transferable to any other individual or party by any form of communication.
7.11
If persons disclose James Rose' contact information, or any other restricted information, to any other individuals or parties, their permission to access this classified information will be revoked. Any future re-applications will be automatically disregarded.
7.12 Applications will be accepted if it meets the following requirements:
i.
Applicants must describe the information to which access is desired;
ii.
its level of classification (confidential, secret or other) - see paragraph (m);
iii.
the reasons for requesting access;
iv.
agree to the 'Terms of Services' agreement.
v.
the names of individuals for whom access is requested; and
vi.
the reasons why access is requested for those individuals.
7.13
There are three levels of classified information:
i.
Level One - e-mail addresses only;
ii.
Level Two - e-mail addresses and land telephone numbers; or
iii.
Level Three - personal e-mail addresses, land telephone numbers, mobile telephone numbers, facsimile numbers, pager numbers, mini-com numbers, personal street addresses, and any other contact information.
7.14 James Rose reserves the right to award applicants security clearances / classification levels different to the requested clearances on his / her application form. He also reserves the right to terminate this service without any prior notification, or alter the classification clearances.
8. INDEMNITY
You agree to indemnify and hold James Rose'
Web Sites and their employees and agents harmless from and against all
liabilities, legal fees, damages, losses, costs and other expenses in relation
to any claims or actions brought against the Web Sites arising out of any
breach by you of these Terms and Conditions or other liabilities arising out of
your use of these Web Sites.
9. SEVERANCE
If any of these Terms and Conditions should
be determined to be invalid, illegal or unenforceable for any reason by any
court of competent jurisdiction then such Term or Condition shall be severed
and the remaining Terms and Conditions shall survive and remain in full force
and effect and continue to be binding and enforceable.
10. GOVERNING LAW
These Terms and Conditions shall be
governed by and construed in accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.
